Blatherwick v. Hotovy, Doc. 1086 No. 435 (District Court of Douglas County)

John A. Kinney represented Mr. Blatherwick who was convinced by Ms. Hotovy that he was the father of her unborn minor child. Mr. Blatherwick lived outside the state of Nebraska while Ms. Hotovy lived in the Omaha area. Throughout the pregnancy, Ms. Hotovy convinced Mr. Blatherwick to provide her with financial support from afar to care for herself as well as the parties’ unborn child. When Mr. Blatherwick insisted on visiting Ms. Hotovy and ensuring she was receiving the care she needed Ms. Hotovy went so far as to claim their child was born prematurely and died. The Douglas County District Court of Nebraska held that Ms. Hotovy led Mr. Blatherwick to believe that she was pregnant with his child and that he needed to provide her financial assistance during the term of her pregnancy. The Court specifically found that Ms. Hotovy was never pregnant and lied to Mr. Blatherwick in order to obtain funds from him in the amount of $31,087.76. A judgment was entered against Ms. Hotovy, and she was ordered to pay the full amount back to Blatherwick.
